Terms & Conditions
Governing law: Republic of South Africa (RSA). These terms supplement the CPA, ECTA and common law.
1. Quotes & pricing
- Quotes are valid for 7 days unless stated otherwise and may change with supplier pricing or exchange rates.
- Unless specified, prices exclude VAT, branding setup, delivery and artwork charges.
2. Orders & payment
- Orders commence on written approval of the quote and artwork proof.
- Standard terms: 50% deposit to start; balance payable prior to dispatch. Credit terms only by prior approval.
- Ownership remains with SunnySA until payment is received in full.
3. Artwork & approvals
Client warrants they own or have rights to use supplied artwork. Production follows the final approved proof; SunnySA is not liable for errors present in the approval.
4. Lead times
Lead times are estimates from proof approval and deposit receipt. Urgent jobs may attract rush fees. Force majeure, supplier delays, load-shedding or courier issues may extend timelines.
5. Delivery & risk
Risk passes to the client upon delivery/collection. Inspect goods on receipt and notify issues within 48 hours.
6. Tolerances
Reasonable industry tolerances apply for colour (Pantone vs substrate), placement (±3–5 mm), and garment sizing variances.
7. Cancellations
Orders for customised goods cannot be cancelled after proof approval. For unbranded orders, supplier fees and handling charges may apply.
8. Warranties & liability
Goods carry supplier warranties where applicable. To the extent permitted by law, SunnySA excludes indirect or consequential loss. Remedies are limited to repair, replacement or refund as per CPA.
9. Governing law & disputes
RSA law applies; venue of jurisdiction: South Africa. Parties shall first attempt to resolve disputes in good faith.
