This Privacy Policy explains how Sunny SA (Pty) Ltd (“SunnySA”, “we”, “us”) collects, uses and protects your personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA) and other applicable South African laws, including the Electronic Communications and Transactions Act, 2002 (ECTA).
1. What we collect
- Identity & contact details: name, company, email, phone/WhatsApp.
- Order details: items requested, quantities, branding files/specs, delivery address, deadlines.
- Communications: emails, WhatsApp messages, quotes, approvals.
- Technical: basic site analytics and cookies (see Cookies Policy).
2. Purpose and lawful basis
We process information to provide quotes, fulfil orders, arrange branding and delivery, maintain records, and comply with legal obligations. Our lawful bases under POPIA include consent, performance of a contract, and legitimate interests (running our business and servicing clients).
3. Sharing
We may share information with trusted processors strictly for order fulfilment: our product suppliers (including Amrod), branding partners, couriers, payment providers, and IT/hosting providers. We require appropriate confidentiality and data protection undertakings.
4. Cross-border transfers
Some processors or cloud services may be located outside South Africa. Where transfers occur, we take steps to ensure comparable protection as required by POPIA Section 72.
5. Storage & security
We use secure systems, role-based access and reasonable technical/organisational measures to protect information. Records are retained only as long as necessary for the purposes above and to meet legal/accounting requirements.
6. Your POPIA rights
- Access, correction or deletion (where legally permissible).
- Objection to processing and withdrawal of consent (does not affect prior lawful processing).
- Lodging a complaint with the Information Regulator (South Africa): inforegulator.org.za.
7. Children
Our services are for business customers and adults. We do not knowingly process information of persons under 18.
